DERIVATIVE WORKS GUIDELINES

VMuslimah Productions (hereinafter referred to as "VMuslimah") has established the following "Guidelines" for the creation and publishing of derivative works.

1. Copyright Act 1987

VMuslimah's Muslim VTubers' designs, illustrations, artworks, web comic, animated shorts, animated clips, animations, music videos, music, etc (hereinafter collectively referred to as "Creative Assets") are proprietary assets owned exclusively by VMuslimah, and protected under the Malaysian Copyright Act 1987, and other applicable laws and regulations.

Under no circumstances will VMuslimah relinquish its rights and/or ownership of its Creative Assets under these Guidelines. VMuslimah maintains full rights and ownership to all of its Creative Assets.

2. Right to Use Derivative Works

VMuslimah reserves the right to use, distribute, broadcast, and publish derivative works created by the user for marketing and promotion purposes, on various platforms throughout the world, without any compensation of any kind to the user.

3. Permission to Use Derivative Works

The user agrees and allows VMuslimah to use, distribute, broadcast, and publish its derivative works on various platforms throughout the world, without any compensation of any kind to him/her.

4. Prohibited Contents

  • Derivative works that are misleading and represented as official;
  • Derivative works that are for profit;
  • Derivative works that are NSFW;
  • Derivative works that promote pedophilia;
  • Derivative works that promote LGBTQIA+;
  • Derivative works that promote Islamophobia;
  • Derivative works that promote violence and hate;
  • Derivative works that promote racial discrimination;
  • Derivative works that promote online gambling, get-rich-quick schemes, cryptocurrency and NFT investments, and/or any other form of investment products;
  • Derivative works that contradict morality and public order;
  • Derivative works that contain matters relating to ideology and politics;
  • Derivative works that mock and/or ridicule religious beliefs;
  • Derivative works that harm and/or damage VMuslimah's brand image;
  • Derivative works that harm and/or damage VMuslimah's Muslim VTubers' image;
  • Derivative works that harm and/or damage third party’s image, and/or violates their rights; and
  • Other derivative works that VMuslimah deems unsuitable.

5. Indemnification and Hold Harmless

VMuslimah shall not be held responsible should the use, distribution, broadcast, and publication of a derivative work by the user, result in a dispute with a third party.

VMuslimah shall not be held responsible for the loss, damage, and expense incurred by the user should a dispute with a third party arise.

The user hereby agrees that he/she is solely responsible for any derivative works that he/she has created.

The user further agrees to indemnify and hold VMuslimah, its owners, directors, employees, contractors, suppliers, licensors, and/or agents thereof, harmless against all liability, loss, damage and expense (including attorneys’ fees) resulting from or arising out of the use, distribution, broadcast, and publication of a derivative work created by him/her.

6. Declaration

By creating and publishing derivative works based on VMuslimah's Creative Assets, the user acknowledges that he/she has read and agrees to be bound by the terms and conditions outlined in these Guidelines, Terms of Use, and Privacy Policy.
